Partner Visas

Partner visa (subclass 820/801)

Requirements:

  • You must be married to or in a de facto relationship with an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen.
  • You must be in Australia (onshore) when you apply for the visa and when the visa is granted.

Subclass 820 visa allows you to remain in Australia on temporary basis (usually with a waiting period of two years from the date you applied for the visa).

Subclass 801 visa is a permanent visa. Usually after the above waiting period (if applicable), you are still in a relationship or married to your partner and you are still eligible for this visa, the subclass 801 visa will be granted.

 

Partner visa (subclass 309/100)

Requirements:

  • You must be married to or in a de facto relationship with an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen.
  • You must be outside Australia (offshore) when you apply for the visa and when the visa is granted.

Subclass 309 visa allows you to remain in Australia on temporary basis (usually with a waiting period of two years from the date you applied for the visa).

Subclass 100 visa is a permanent visa. Usually after the above waiting period (if applicable), you are still in a relationship or married to your partner and you are still eligible for this visa, the subclass 100 visa will be granted.

 

Prospective Marriage visa (subclass 300)

Requirements:

  • You must be outside Australia (offshore) when you apply for the visa and when the visa is granted.
  • You must be of opposite sexes (same sex couples are not eligible for this visa subclass – refer to de facto relationship for partner visas instead).
  • You and your prospective spouse must have met in person.
  • You must genuinely intend to marry and live as husband and wife.
  • Your marriage must occur within nine month of your visa validity. If the visa expires and the marriage has not occurred yet, you will be required to return to your country of origin.

Subclass 300 visa allows you to enter Australia and marry your prospective spouse who is an Australian citizen, Australian permanent resident or an eligible New Zealand citizen. You can work and study in Australia. Following this visa, you can apply for a Partner visa.
